FIDIC Agreements/Contracts

The best-known international standard form of construction contract is FIDIC. At Ridgemont, we have a specialised team of construction solicitors who can assist with contract negotiation, drafting and dispute resolution.

When it comes to international projects many people in the industry turn to the FIDIC for standard form contracts.

Construction and engineering projects come in many shapes and sizes. Projects are usually complex in nature and therefore often involve detailed negotiations and consideration of the contract, at all stages up to completion and beyond.

We have the knowledge and expertise to provide the full range of legal advice in relation to negotiating, drafting and dispute resolution of construction contracts.

FIDIC Agreements

The contractor's main obligation under any construction contract is, of course, the construction and completion of the works within the specified time for completion and in accordance with the contract.

FIDIC can be a complex area of law as there are many key terms of the contract that focus on flow down, risk and liability, payment, claims, termination and dispute resolution.

Care needs to be taken when disputes arise as a contractor may find that the claim is subject to limitation if it does not follow the specific contractual requirements.

Dispute Resolution

FIDIC contracts adopt a multi-tier dispute resolution process. The emphasis in recent years has been on the amicable settlement of disputes. The process usually provides as a first step, for disputes to be submitted for judgment before an Engineer or Dispute Board. If the parties cannot settle the dispute during the ‘amicable settlement’ period, the final stage is to proceed to arbitration.

Sumary

The effective administration of a FIDIC construction contract is essential to ensure that time and money claims are protected. It is important to write notices in clear and unambiguous terms. Keeping effective records will assist contractors and employers to prove their entitlements and enable both parties to precisely ascertain their positions if a dispute arises.

We have experience of drafting amendments to all standard forms and their negotiation with the other parties.
